Facts Regarding the BIS and ISI Certification
Bureau of Indian Standards (BIS)
The Ministry of Consumer Affairs, Food, and Public Distribution in India is in charge of BIS, which sets quality standards for products and grants BIS Certification for a specific number of products. A BIS hallmarking is for consumer goods like electronics, jewellery made of Gold, silver, etc., and other similar things. It means that the product has been tested for its quality, its durability, and, in the case of jewellery, its purity of materials.
Indian Standards Institution (ISI)
How to find the BIS or ISI Mark on any Product?
It is mandatory to have an BIS registration for some specific number of products. The BIS or ISI mark is usually printed on the product's packaging, but if it isn't, it is printed somewhere else on the product (which is very rare). At the moment, there's no way to check these marks when shopping online because shopping portals don't list this information. However, big platforms like Flipkart and Amazon require sellers to fill in information about BIS for required products in order to sell goods online. Therefore to have an ISI mark on the their products, the sellers have to complete the ISI registration process.
The Penalty for using a BIS or ISI Mark Wrongly
If anyone is caught breaking the rules in sub-sections (6) or (8) of section 14 or section 15 of the BIS Act, 2016, they will be punished.
Imprisonment for up to one year.
Fine of 1 lakh to 5 times the value of the product.
If the worth of the product cannot be determined, the fine will be equal to the total turnover of the preceding fiscal year.
If any person is found to be in violation of Section 17 of the BIS Act, 2016, they will be punished with imprisonment for up to two years.
Fine of 2 lakhs for first violation, 5 lakhs for second and subsequent violations, up to a maximum of 10 times the product's worth.
